In the article Preparing to Buy A Home in the March 2006 issue, I noticed that it talked about preparing a budget, but didnt give details. As someone with a 15-year mortgage who is about to make my Sinai payment, I think you need to advise new homeowners to build plenty of flexibility into their budget for maintenance and upkeep. Building wealth is important, but not taking care of the biggest asset most Americans have is a waste of money. Please encourage our people to consider home upkeep when configuring their budget, so our homes appreciate, especially in neighborhoods primarily occupied by minorities. Buying homes to build wealth but not maintaining them is living beyond our means and is just as bad as losing ground in any other area of our finances.

A volunteer committee organized by the Utah Bar Association will spend the next few months untangling several divorce, child custody and other family law bills that knotted up at the end of the last session of the Legislature. Both the philosophical motivation and practical application of about 20 bills will be evaluated by a 17-member ad hoc committee, which was granted permission to organize by the Judiciary Interim Committee last week. Bills that addressed topics such as establishing a state office that would enforce court-ordered child visitation, false allegations in a divorce and refining child support payment schedules when children spend extended time with a noncustodial parent created a lot of confusion, especially in the Senate at the close of the session.
Why do we concern ourselves with such things? The concept of the contract allows people to make commitments between themselves that the state will enforce–the result being future stability of relationships, avoidance of conflict, and general societal harmony. How odd, then, to apply these concepts to family law! It might fairly be said that the whole of family law concerns itself with addressing members of society where relationships are no longer stable, where conflict abounds, and where harmony has ceased to exist. The concept of family, I think, arises only in the context of some directly stated or some implied commitment. A husband promises to share his life with his wife. Beyond the formal commitment of marriage, separate or same-sex couples can likewise expressly, or by implication, promise to share their lives with their partners. Parents promise to care for and support their children. Each of these commitments could be said to be some form of express or implied commitment between people.

Back in the old days, when a lawyer or lawyers helper needed to bone up on a particular point of law, he or she would enter a place known as the “library” and consult something called a “book.” Thats the way it was in 1983 when Charles McCowan helped launch Kean, Miller, Hawthorne, DArmond, McCowan Jarman. Maybe law books arent that obsolete yet, but theyre close. Everythings gone electronic for crying out loud. “Now the bulk of people here use computerized research, except us dinosaurs who dont know how to do it,” McCowan says.
The task of code drafters is facilitated when they can proceed from the assumption that a single paradigm governs the lawyers role-either a paradigm encapsulating a theory of behavior (how lawyers ordinarily act) or a paradigm encapsulating a normative ideal (how lawyers should act). When code drafters rely upon multiple paradigms (for example, lawyers should act as clients alter egos and as officers of the court), inconsistent regulatory mandates can result, and lawyers may become confused about their functions. The ABAs 1908 Canons of Ethics, which prevailed in most American jurisdictions throughout the early twentieth century, suffered from an emphasis on inconsistent ideals.1 The bar was in a state of disagreement about lawyers roles and lawyers had no point of reference for determining how to act.2 Therefore, when the ABA adopted the first concrete professional code in 1969,3 it became important for the drafters to identify an over-arching theory. By emphasizing the lawyers place in the adversarial system, the 1969 code served a forceful unifying and educational function.4 Nevertheless, an ethics codes overemphasis on a single paradigm can lead to undesirable results. It tends to produce idealized rules that either rest on counter-factual assumptions or impose obligations on lawyers that are so inconsistent with their personal incentives that violations become routine. In modern times, an exclusive focus on the adversarial ethic seems less important than in 1969 because lawyers have developed a shared sense of core obligations to clients and of the part lawyers play in the legal system. The recent history of lawyer regulation reflects a desire on the part of the bar to fine-tune the basic message of the 1969 code-to recognize more nuances than, perhaps, a single image of lawyers can accommodate.5 The task of drafting professional rules is complicated by the fact that the public perception of the bar is not unitary. Society views lawyers in many different, and sometimes inconsistent, ways. These multiple conceptions influence code drafters. In practice, the modern legal ethics codes incorporate a number of “images” of lawyers as bases, or catalysts, for disciplinary rules. Relying on these images has consequences for how the codes treat lawyers and, as a theoretical matter, for how the rules should be drafted.
Last month I wrote about the Lawyers-Helping-Lawyers Committee as a resource for an impaired lawyer. I wrote about courage and compassion to oneself and to fellow attorneys to admit impairment and to seek recovery. Today I want to discuss the equally troubling and less pollyannaish facts of life — many impaired lawyers refuse assistance. When you have mustered the courage to confront a fellow attorney about an impairment, you have done so assuredly because you have become convinced that your friends impairment is destroying his life. You already know that that person must get help — voluntarily or involuntarily. You know that to allow them to continue impaired leads only to death and destruction. Death in a physical sense for the impaired lawyer through alcoholism, drug abuse or suicidal despair. Death for innocent people who die, for example, in auto accidents when your impaired friend gets behind the wheel. Destruction for the impaired lawyers family and loved ones who cannot continue living sane and dignified lives with the impaired person. Destruction for the impaired lawyers clients who do not receive the competent, diligent representation they deserve. As a matter of morality, you should act to save your friend and (indirectly) those around him — family, innocent people, clients. As a matter of self-protection, you must act because failure to act can lead to professional discipline. The Bar is a self-regulating profession. If you have knowledge of a lawyer or a judge impaired in their fitness for professional duties, Rules of Professional Conduct (RPC) Rule 8.3 mandates that you “shall inform the appropriate professional authority.” Failure to report when appropriate is itself a disciplinary violation. If you are a partner or a supervising lawyer, you are accountable under RPC Rule 5.1 for anothers ethical violations if you have failed to adopt the reasonable measures in your firm that assure compliance with ethical conduct. In addition, Rule 5.1 also imposes personal ethical responsibility upon you if you know of an impairment and fail to take reasonable remedial actions that can avoid or mitigate the consequences of anothers (the impaired lawyer) professional misconduct. As these violations of Rule 5.1 are your personal ethical obligations, you may also have malpractice liability for your failure to act to prevent harm, even though you have tried to insulate yourself by becoming a limited liability company or a limited liability partnership. Who is the appropriate professional authority to whom you must report an impaired lawyer? As I have already intimated, if the impaired lawyer is willing voluntarily to seek recovery and has not committed an ethics violation, the appropriate professional authority is the Lawyers- Helping-Lawyers Committee. You may refer the impaired lawyer willing to seek recovery to the L-H-L for the committees guidance, counseling and monitoring. As to the recalcitrant impaired lawyer, the appropriate professional authority is the general counsel of the Bar Association. The general counsel may invoke Rule 10 (suspension for personal incapacity to practice law) of the Rules Governing Disciplinary Proceedings (RGDP). Under Rule 10, the general counsel may initiate a proceeding to suspend the incapacitated lawyers license. If suspended, the Supreme Court will not return the lawyers license until the lawyer can prove, through reinstatement proceedings, that he once again has the personal capacity to practice law. Rule 10 means to protect clients and the public from an impaired lawyer. Rule 10 is not geared toward disciplining (punishing) a lawyer for an ethics violation. Consequently, Rule 10 is a confidential proceeding on a separate, non-public docket under the direct supervision of the chief justice. By contrast, if the impaired lawyer has already caused a harm to a client that violates the Rules of Professional Conduct, the appropriate professional authority is again the general counsel of the Oklahoma Bar Association. But now the general counsel invokes the usual disciplinary procedures in RGDP Rule 6. These disciplinary procedures are open to the public once the court clerk of the Supreme Court files the formal complaint and the respondent lawyers answer. When the general counsel becomes involved through either Rule 10 or Rule 6 in proceedings relating to an impaired attorney, the general counsel also invokes RGDP Rule 12 (winding up business of lawyer who is deceased, incapacitated or missing not pending disciplinary proceedings). Rule 12 is a relatively new rule, adopted in December 1996. Rule 12 authorizes the general counsel to exercise oversight appropriate to the circumstances to protect the impaired lawyers clients. Lawyers need courage and compassion about impairment for themselves and for fellow lawyers. Lawyers also need awareness of their ethical obligations to report impaired lawyers to the appropriate professional authority. In recent years, a number of significant changes have been made to the Criminal Code: sometimes to give the police new tools in the investigation of criminal offences; sometimes to define new crimes; and sometimes to change the formal legal processes by which the courts decide whether the criminal law has actually been violated, and if so, what the proper response might be. Rarely do the changes involve decriminalizing prohibited conduct or enhancing and protecting the rights of those accused of crime. Most of the recent developments reflect a stricter approach towards those who break the law and demonstrate a clear willingness on the part of government to listen to and accommodate the requests or demands of law enforcement, victims groups, and similar bodies and interests within society. One of the most significant changes in the last several years was the creation of a national DNA data bank containing the profiles of individuals convicted of the most serious criminal offences. In June 2000, legislation became effective which required convicted persons to provide blood or other bodily samples for the purposes of DNA data banking (the dates used in this article are usually those when the laws in question were brought into force even if they might from time to time be referred to as the dates of enactment). Now, persons convicted of the most serious offences–including murder, sexual offences, kidnapping, and various terrorism-related crimes–are required to provide samples from which their DNA may be extracted and then catalogued in a national data bank maintained by the RCMP in Ottawa. (Persons convicted of certain less serious offences may also be required to provide samples if a judge decides this is appropriate in the circumstances.) The information in the data bank is then used whenever DNA is found at a crime scene which cannot be identified as being that of a known offender, witness, or complainant. The unknown DNA can be compared to all of the samples in the data bank to determine whether someone previously convicted of an offence is somehow connected to the unsolved crime. Another tool even more recently handed to the police came with the December 2004 enactment of the Sex Offender Information Registration Act. Under this legislation, persons found guilty of having committed virtually any sexual offence will now be required to provide certain personal information about their history, whereabouts, and daily lives to the local police who will ill turn enter those details into a national database, which again, will be maintained by the RCMP. These offenders will have an ongoing obligation to keep the police informed of any changes to the personal details registered, and this obligation will continue for not less than five years and may last for the rest of the individuals life. The information collected will then be made available to police agencies that need it in the course of investigating a crime of a sexual nature.

Race is one of the most sensitive aspects of the public debate on crime, striking at the heart of whether our justice system is fair. Clearly, from a statistical point of view, an American citizens relationship to the criminal justice system is heavily influenced by his or her race. According to the Sentencing Project, a group that advocates alternatives to incarceration, one in three black men ages 20 to 29 was under the supervision of the criminal justice system in 1995 (for white men, the ratio was one in fifteen that year; for Hispanics, one in eight). Whether these differences result from a disproportionate percentage of crime by black people, discriminatory sentencing, disparities in quality of counsel, something as fundamental as economic disadvantage among blacks, or some combination of these factors, is open to debate. Hypnotherapy is the therapeutic use of hypnosis. In hypnotherapy, hypnosis is used by psychotherapists to modify a patients behavior. According to the American Association of Professional Hypnotherapists, there is a 75-90% chance of effectively changing behavior with hypnotherapy. Once the patient has seen a hypnotherapist, self-hypnosis can be learned, and is sometimes recommended as part of the treatment plan. Preparation


Hypnotherapy requires only that the patient desire to change a certain type of behavior. To come up with a different image no matter what it takes For the last twenty years, Milian has been bringing that edgy spirit of innovation to sports photography as a staff photographer at Sports Illustrated. He has mounted a remote-controlled camera on the front of a kayak-, dangled from helicopters, and spent a week in the Colombian jungle photographing a boxing dynasty. All the while, though, his work remained grounded in the basics of lighting and composition. He does mostly indoor work for SI, and his photos inevitably capture the defining moment of the action with studio-like quality and precision. Consider his preparation for a basketball game at Madison Square Garden: he arrives at one in the afternoon - five cases of equipment in tow - for a 7 Pm. tip-off. Depending on what hes after, he may set up eight or more cameras - on the catwalk, mounted behind the backboard glass, in the stands, and on the floor. Each is synchronized with his hand-held camera via a Flash Wizard, a radio-controlled device that allows him to get the same shot from multiple angles. Next, a set of strobe lights is set tip in each corner of the court, also synchronized like the cameras. most of srs indoor jobs are shot using strobes rather than natural light. In the 1940s, the World Health Organization (WHO) defined health as a state of complete physical, mental, and social well-being and not merely the absence of disease or infirmity. To the small business owner, the real question is, Where does the hype end and the reality begin? Is the Internet really a viable proposition for the traditional small business, normally constrained by lack of time, staff and money? 10 questions to ask yourself The best way to determine whether or not the Internet makes sense for your business is to apply a simple “yes” or “no” answer to 10 important marketing questions: 1. Do my clients require specific product information before they can buy my product/service? 2. Do I spend a majority of my time selling the benefits of my product only to be asked, “Can you send me more information?” 3. Is my long-distance phone bill more than $100 per month? 4. Have I lost business as a result of playing phone tag with a potential customer because I was unable to “sieze the moment?” 5. Would a new employee handling sales paperwork free me to increase my companys revenues? 6. Is there an international market for my product? 7. Does my product have a story to tell? 8. While creating some Web pages may require the skills of a computer Ph.D., most will not, and there are competent companies in most major markets capable of accomplishing the task in a cost-effective fashion. Prices for creating a simple Web site can range from a low of $2,500 to high of $20,000. In fact, some of the Fortune 500 marketers have created sophisticated and complex Web pages that can literally run into the hundreds of thousands of dollars, and in some cases, the millions. But for the average small business, the investment will probably be in the $5,000 to $10,000 range. And remember, you must keep your Web site content fresh, or your prospects will have no reason to come back. Seeing your own World Wide Web site up and running on the Internet can be a proud moment for any business owner. It also can mean the start of a whole new way of doing business. It has the potential to increase productivity by extending operating time to a full 24 hours a day. But this will only happen if your business really needs this technology and can use it effectively. A Bellevue, Wash.-based diagnostic imaging provider has bought InStar Systems International, a Colorado Springs developer of software for radiology departments and imaging centers. The deal closed Thursday. Terms werent disclosed. “InStar is focused primarily on servicing the small hospital and freestanding imaging center marketplace. ATLANTA — Email marketers feel like theyre taking two steps forward and one step back when it comes to growing address lists, according to a recent JupiterResearch survey commissioned by Silverpop. Theyre making progress, but its a slow slog uphill. Concerns over list growth arent necessarily new, but its interesting that its become a top concern for email marketers, said Elaine OGorman, vice president of strategy for Silverpop. Growing a strong database of customers and prospects is obviously the core part of any strong email marketing program. All elements of sophisticated email marketing - segmentation, personalization, dynamic content, lifestyle marketing and more - depend upon the quantity and quality of the email list. Yet while marketers work diligently to add new names to the list, others drop off or become inactive. List attrition for BtoB marketers averages 2.1 percent a month, according to MarketingSherpas Email Marketing Benchmark Guide 2007. The report indicates BtoC marketers lose, on average, 2.9 percent of their email addresses each month.
Although the availability of legitimate email lists is improving, direct marketers need to exercise considerable caution in such selections to avoid privacy complications and maximize response potential. * Make sure its an opt-in list, and check the methodology. I am talking about the chronic givers–elderly people and those who are doctor dependent. One woman has kept me in eight varieties of home made jam for years. To her I give excess produce from my garden (whether it is suitable for incorporation in jam or not). Patients who insist on bringing chocolate for my children on ever), visit receive some sort of confectionery from them at Christmas. You may argue that by this reciprocity I am perpetuating the situation. I feel it restores a balance. Some patients do not like it, which is fine by me. If they refuse to accept a gift from me how could I possibly take one from them? At this point I have to admit that I was brought up giving presents to patients. I clearly remember, as a child in the 60s, doing the Christmas round with my father, who was also a general practitioner. The back of his car contained a large cardboard box of poinsettias and half a dozen individually wrapped baby bottles of champagne. As darkness fell and Christmas lights came on in windows we would drive from one fusty home to another, greeting impossibly old and decaying and undoubtedly lonely people. Everywhere the welcome was warm; sometimes there were drinks and mince pies, and we collected chocolates and bottles ourselves as the afternoon progressed. These patients had become special to my father over the years by virtue of their age, their disabilities, their social isolation, or just their personalities. Moreover, I suspect that giving as well as receiving at Christmas helped him to maintain a position of strength through the ensuing 12 months of regular visiting, a feature of general practice in those days.

In an otherwise unstable economy, the housing market has remained strong, with exceptionally low mortgage rates encouraging many to buy homes, driving up home prices, and enabling homeowners to refinance existing mortgages at lower rates.
